Preamble

Introduction

These Terms and Conditions govern all services provided by AVIBooking OÜ, a private limited company registered in Estonia, operating as a cargo intermediary under IATA’s European Air Cargo Programme. By submitting a quote request or booking instruction to AVIBooking, the client confirms unconditional acceptance of these terms in their entirety. These terms are governed by Estonian law and applicable IATA resolutions. AVIBooking reserves the right to amend these terms at any time — the version published at avibooking.com/terms at the time of booking applies.

Nature of Service

Intermediary Only Protected

AVIBooking OÜ acts exclusively as an IATA-accredited cargo intermediary. AVIBooking does not at any time physically handle, accept, transport, store, or take possession of any cargo, animal, or goods. The contract of carriage is established solely between the shipper and the operating airline upon issuance of the Air Waybill (AWB). AVIBooking is not a party to the contract of carriage and assumes no obligations thereunder.

Non-Handling Declaration Protected

AVIBooking operates under an IATA Non-Handling DGR Declaration. AVIBooking does not accept, process, handle, or arrange carriage of Dangerous Goods at any time. AVIBooking's services are limited exclusively to live animal (AVI) cargo bookings. Any request involving Dangerous Goods, general cargo, or other commodity types will be declined without exception.

Scope of Services

AVIBooking's services consist of: obtaining freight quotes from airlines on behalf of the client; communicating quote details to the client; upon client acceptance, confirming the booking with the airline; coordinating AWB issuance; and providing booking reference and documentation to the client. No other services are implied or included unless agreed in writing.

Professional Clients Only

B2B Service Important

AVIBooking's services are provided exclusively to licensed professional pet relocation agencies and air cargo agents. By submitting a booking request, the client warrants that they are a professional operating in the air cargo or pet relocation industry, that they understand IATA live animal regulations and AWB procedures, and that they are not acting as an end consumer or private individual. AVIBooking reserves the right to decline any request from non-professional clients without explanation.

Client Responsibility Protected

The client, as a licensed professional, assumes full responsibility for:

  • Ensuring the animal is fit for air travel
  • Compliance with all origin and destination country import and export regulations
  • Obtaining all required permits, health certificates, and veterinary documentation
  • Ensuring the container meets IATA Live Animals Regulations (LAR) specifications
  • Ensuring the shipper and consignee are aware of all applicable conditions of carriage

AVIBooking relies entirely on the accuracy of information provided by the client.

Quotes & Booking Process

Two-Stage Process

AVIBooking operates a two-stage process. Stage 1 — Quote: AVIBooking obtains indicative freight rates based on approximate details provided by the client. Stage 2 — Booking: Upon client acceptance of the quote, exact shipment details are confirmed and the booking is placed with the airline. Final charges may differ from the quote if exact weight or dimensions differ materially from those provided at quote stage.

Quote Validity Protected

All quotes provided by AVIBooking are valid for 48 hours maximum from the time of issue, unless otherwise stated in writing. Airline freight rates are subject to change at any time without notice. AVIBooking accepts no liability for rate changes occurring after quote expiry.

Space Not Guaranteed Protected

The provision of a quote does not constitute a reservation or guarantee of space on any flight. Airline space is subject to availability at the time of booking confirmation only. In such cases, AVIBooking will endeavour to source alternative routings at no additional coordination fee.

Breed Restrictions Protected

Certain animal breeds — including brachycephalic (snub-nosed) dog and cat breeds — are subject to airline-specific acceptance restrictions, seasonal embargoes, and outright bans on specific routes. AVIBooking will advise on known restrictions at quote stage but cannot guarantee acceptance of any breed by any airline. Final acceptance is at the sole discretion of the operating carrier.

Seasonal Embargoes Protected

Airlines impose live animal embargoes during periods of extreme temperature at origin, transit, or destination airports. These embargoes may be imposed at short notice, including after booking confirmation. AVIBooking accepts no liability for cancellations, delays, or additional costs arising from airline temperature embargoes.

Payment Terms

Payment Before AWB Release Non-Negotiable

Full payment of all charges must be received in cleared funds before the AWB is released to the client. This includes airline freight charges and the AVIBooking coordination fee. No AWB will be issued, confirmed, or released under any circumstances until payment is verified. This condition applies without exception and cannot be waived.

Coordination Fee

AVIBooking charges a flat coordination fee of €185 per booking. Airline freight charges are passed through to the client at cost with no markup. The coordination fee is non-refundable once a booking is confirmed with the airline, regardless of whether the shipment proceeds.

Payment Method

All payments are made by bank transfer only to AVIBooking's designated account. Payments accepted in EUR and AUD. Credit card, PayPal, and cash payments are not accepted. The client bears all bank transfer and currency conversion fees. Payment is deemed received only when funds are confirmed cleared in AVIBooking's account.

All AVI Charges Prepaid Protected

In accordance with IATA regulations, all charges relating to live animal shipments must be prepaid in full. Charges-collect terms are not available for AVI shipments under any circumstances.

AVI Shipment Requirements

IATA Live Animals Regulations

All live animal shipments must comply with the current edition of the IATA Live Animals Regulations (LAR). It is the client's and shipper's responsibility to ensure full compliance. AVIBooking will advise on LAR requirements upon request but compliance remains solely the client's responsibility.

Required Documentation

  • International Veterinary Health Certificate or Animal Passport — valid and issued by a licensed veterinarian
  • Shipper's Certification for Live Animals — completed in English as required by IATA
  • Import permit from destination country authorities (where required)
  • Export permit or CITES certificate where applicable
  • IATA LAR-compliant live animal container — correctly sized for the animal
  • "This Way Up" labels affixed on at least two opposite sides of the container
  • Commercial Invoice stating the declared value of the animal

Documentation Accuracy Protected

The client is solely responsible for the accuracy, completeness, and validity of all documentation. AVIBooking accepts no liability whatsoever for delays, rejections, fines, quarantine, confiscation, or any other consequence arising from incorrect, incomplete, expired, or fraudulent documentation.

Fitness for Air Travel Protected

The client and shipper warrant that the animal is fit for air travel at the time of acceptance. AVIBooking accepts no liability for the health, condition, injury, illness, or death of any animal during or after transport. All claims relating to animal welfare during carriage must be directed to the operating airline.

Cargo in Bond Protected

If customs authorities detain a shipment and place it in bond, all resulting storage, bond fees, customs duties, veterinary inspection fees, quarantine costs, and release charges are the sole financial responsibility of the client and/or consignee. AVIBooking accepts no liability for costs or consequences arising from customs detention.

Documentation & Information

Reliance on Client Information Protected

AVIBooking acts entirely in reliance on information provided by the client. The client warrants that all information provided is accurate and complete at the time of submission. Any additional costs arising from corrections or amendments required due to client error will be charged to the client in full.

Weight & Dimension Changes

If the actual weight or dimensions of a shipment differ from those provided at quote stage, the final freight charge will be recalculated accordingly. AVIBooking will notify the client of any material charge adjustment before confirming the booking.

Liability

Maximum Liability Critical

AVIBooking's total liability to the client under any circumstances is strictly limited to the coordination fee of €185 paid for the specific booking in question. AVIBooking accepts no liability for: loss, damage, delay, injury, illness, or death of any animal; loss of or damage to any cargo; consequential, indirect, or economic loss of any kind; loss of profit or revenue; or any loss arising from airline delay, cancellation, diversion, refusal of carriage, or customs action.

Claims Against Airline Protected

All claims for loss, damage, delay, or non-performance of carriage must be submitted directly to the operating airline under the terms and conditions of the Air Waybill and the applicable Convention (Warsaw or Montreal). AVIBooking will provide reasonable assistance to the client in pursuing such claims but accepts no financial liability therefor.

Force Majeure

Force Majeure Events Protected

AVIBooking accepts no liability for any failure or delay in performance arising from circumstances beyond its reasonable control, including but not limited to: weather events, natural disasters, acts of God, pandemic or epidemic restrictions, government or regulatory actions, airspace closures, airport closures, airline operational decisions, aircraft technical issues, labour disputes, strikes, war, civil unrest, terrorist acts, quarantine orders, temperature embargoes, or IATA regulatory changes. In such circumstances AVIBooking will use reasonable efforts to rebook or find alternative solutions but accepts no financial liability for additional costs incurred.

Cancellations & Amendments

Cancellation Policy Important

Cancellation requests must be submitted in writing to AVIBooking immediately upon the decision to cancel. The €185 coordination fee is non-refundable under all circumstances once a booking is confirmed with the airline. Airline freight charges are subject to the cancellation policy of the operating carrier — any airline cancellation fees are passed through to the client in full.

Amendments Protected

Booking amendments — including date changes, routing changes, and weight or dimension updates — are subject to airline availability and the operating carrier's amendment policy. Any airline amendment fees are passed through to the client in full. AVIBooking does not guarantee that amendments can be accommodated.

Governing Law & Disputes

Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Estonia. Where applicable, IATA resolutions, the Montreal Convention (1999), and the Warsaw Convention apply to the international carriage of cargo.

Dispute Resolution

In the event of a dispute, the parties agree to attempt resolution through good-faith negotiation within 30 days of written notice of the dispute. If unresolved, disputes shall be referred to binding arbitration in Tallinn, Estonia, conducted in English under Estonian law. The client waives any right to bring claims in any other jurisdiction.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force and effect.

Entire Agreement

These Terms constitute the entire agreement between AVIBooking and the client with respect to the services provided and supersede all prior communications, representations, or agreements. No variation to these Terms is valid unless agreed in writing by AVIBooking OÜ.
